ANTECEDENTS
The Registry of Names of domain under ccTLD MX, is administered by the Center of Information services and Registry in Internet, NIC Mexico, of the Technological Institute and Superior Studies of Monterrey, Monterrey Campus by delegation of IANA (Internet Assigned Numbers Authority) and ICANN (for Internet Corporation Assigned Names and Numbers), according to the principles contained in document RFC 1591.

In November of 2003, the TECHNOLOGICAL INSTITUTE and OF SUPERIOR STUDIES OF MONTERREY formalizes its previous relation with MEXICO Network Information Center, S.C. (in ahead NIC Mexico) to carry out the functions related to the administration and registry of the names of domain under ccTLD MX.

GENERAL DISPOSITIONS
The applicant of a name of domain in NIC Mexico declares that she knows and accepts the annexed Policies, procedures, regulations and with relation to the name service of domain, including his registry, modification, suspension, cancellation and disputes of domain names.

Any modification or update to these Policies will be published with a warning of at least 15 days natural immediate previous to the date of their take effect, in the page of the NIC Mexico: www.nic.mx , with object of which the holder shows what to his interests he agrees. Passed east term without the holder has showed conducive to the changes and the modifications, they will have total validity and legal effects, and will be considered obligatory for the parts.

DEFINITIONS
Name of domain
It represents a common identifier a group of computers or equipment connected to the network. They are a simple form of Internet address designed to allow the users to locate of a easy way sites in Internet.

When soliciing the registry of a name of domain in MX, without providing a DNS at least will be understood that this name of domain could not be announced by any DNS in Internet.

DNS
Used abbreviations to talk about to the Domain Name System (System of Names of domain) and/or to the Domain name server (Servant of Names of domain) of indistinct way. First it is the system of used calculation to vice versa translate names of domain in IP directions and, and the second it corresponds to the equipment of calculation used to perform the function of resolution and translation of domain names.

ccTLD
Used abbreviations to designate to the names of domain of first level, known like territorial codes (Country Code Top Level Domain). These abbreviations talk about to the classification in the system of domain names (DNS), represented by a suffix of two letters, assigned according to the codes standard of ISO3166-1 for the representation of names of countries or territories.

Applicant
Any physical or moral person who initiates the request of a name of domain to her name or by order of third.

Contacts
People in charge for a name of domain in individual, exist three types of contact for each name of domain: administrative, technical and of pago.Cada contact he will have assigned a called identifier NIC-ID, which will be able to register in: http://www.nic.mx/es/contacto.registro.

Administrative Contact
Representative of the Organization and person in charge of the use of the domain name. User of the domain name.

Technical Contact
Person in charge of the service of DNS in which one is lodged the domain name.

Contact of Payment
Person in charge to receive notifications of payment and to make the corresponding payments.

Days
The terms and periods established in days will be understood like natural, unless they are specified like capable for certain section.

Holders of the Name of domain
Administrative contact and Technical Contact of the domain name.

Organization
Physical or moral person who asks for the registry of a domain name.

Authority
Any authority with faculties and/or jurisdiction sufficient to know subjects related to these policies, procedures and their modifications or replacements, as well as any group of experts, referee, organism or by arbitration panel before those who the parts had been put under taking care of the policies and procedures described here.

WHOIS
System of Data base used for the consultation of domain names and its main data, which can be consulted publicly through the page of NIC Mexico. Mechanism to verify and to verify the titularidad of a domain name.

MAIN DATA
Data provided by the applicant in the process of registry of the domain name: Name of the domain; Name, Direction and ORG-ID of the Organization; Name, Telephone, Electronic mail and NIC-ID of the Contacts Administrative, Technical and of Payment of the domain name; Name or Direction IP of each one of the servants of names of the domain.

IP
Internet Protocol. Used nomenclature to assign to the calculation equipment a numerical direction.

I. Of the Names of domain
A name of domain under MX must have the following characteristics:
The length overall of the name domain, without including the characters of the classification (to see Annexed, Table of Classifications under MX.) it will not have to exceed the 63 characters.
The valid characters are numbers, letters of the English alphabet and the script (-).
The domain names will not have to begin or to finish with the script (-) nor to take two scripts (- -) followed.
A domain name is not a page WEB.
A domain name is not an electronic mail.

II. Of the Registry of Names of domain
By the acceptance that NIC Mexico does of a request of the registry of a domain name recognizes the right of the holders the use, we enjoyed and enjoys the domain name, without by the previous thing it is understood the transmission and/or cession of the rights of property of the same one.
By the fact to ask for the registry of one or more names of domain under the completion MX, is understood that the holders know and accept:
The express commitment to accept and to govern themselves by the General Policies of Names of domain, the Policy of Solution of Controversies in the matter of Names of domain for MX (LDRP), the Regulation of the policy of solution of controversies in the matter of names of domain for MX (the "Regulation") and the annexes, without reserves of any species;
That the declarations that have carried out in the procedure for the registry of or nombre(s) of domain are certain, exact and complete, also it accepts the obligation to update this information, with the purpose of guaranteeing that it continues being at any moment correct and exact during the period of registry and/or use of the domain name or;
That the breach of the previous interjection is reason for the application of the point VI.a.iii and IV and VI.b.v;
That at the time of registering Contacto (NIC-ID) and password before NIC Mexico they assume the responsibility to maintain the confidentiality of this last one, reason why they will be responsible by the use that becomes of its NIC-ID and password.
That they are of legal age and they are in the heat of use and we enjoyed its ability to act.
That NIC Mexico simply is administering the space of names of domain under MX, and that therefore, any consequence derived of the registry and/or use from domain names that constitute or could constitute violations to the applicable legislation, is titular exclusive responsibility of the name of the domain name;
That to their loyal one to know and to understand, neither way nor the registry or nombre(s) of domain in which is to be used violate directly or indirectly right of third;
That they do not register or the names of domain with illicit aims;
That they do not acquire rights of registered tradenames and that is responsibility of the holder of the domain name to make sure that it is not violating any right on a distinguishing sign such as: registered tradename, commercial warnings, as well as reserves of rights, or any other right of intellectual or industrial property and in general applicable the national and international ordering legal in the matter;
That they are total and absolutely responsible by the use for the name of the domain and in such use, people in charge become not only of their own acts but of those of their employees, agents, relatives or third. Also he commits himself out of danger to leave to NIC-Mexico of any action derived from the use and/or registry of the domain name;
That they authorize to that the main data, provided in the procedure of registry of or the domain names, as well as dates related to the registry and modifications to or the domain names, appear in the data base WHOIS or which are published, they transmit, they reproduce publicly, they disclose and they communicate by NIC Mexico;
That any data or information provided by the applicant, by the contacts or any information generated in the registries of NIC Mexico related to the domain names can be sent to the Authority that therefore asks for it;
To be put under the Policy of Solution of Controversies in the matter of Names of domain for MX (LDRP), and the Regulation. Also, they accept any resolution derived from these or the procedures established in the General Policies of Names of domain, not reserving action nor straight that to exercise against NIC Mexico; the supplier of services of solution of controversies at issue, the group of experts nor anyone of the members of this group;
The electronic mail like only official mass media with NIC Mexico. In cases where the physical document interchange is necessary, a service of mail will be used in where certainty of the dates of shipment has left and deliveries;
That the present policies could be modified or be replaced listening to the commentaries and opinions sent by the External Consultative Committee, being effective within at least 15 days later to the publication of the proposal of modifications in the pagina of NIC Mexico (www.nic.mx). Once passed the previous term, the holders of domain names will be forced without NIC Mexico is forced to make no other type of publication or warning.
That any modification or update to the Policies of a domain name will be published with a warning of at least 15 days previous to the date of their take effect, in the page of the NIC Mexico: http://www.nic.mx, with object of which the holder shows what to his interests he agrees. Passed east term without the holder has showed the conducive thing, the changes and modifications will have total validity and legal effects, will be considered obligatory for the parts.
That all the communication will be in Spanish language; nevertheless NIC Mexico will be able to answer messages originally written in a language different from the Spanish to consider it thus necessary.

III. Of the Requests of Registry of Names of domain
Requirements
The applicant will be able to provide the name and direction IP of the service of DNS for or the asked for names of domain.
When the direction of IP of the service of DNS is provided, this one will have to return a autoritativa answer to the consultations on the name of domain at issue.
He is requisite indispensable to provide the data that NIC Mexico asks for of the three contacts (administrative, technical and of payment) when soliciing a domain name.
The applicant will have to provide the data of the organization who asks for or entrusts the registry of the domain name.
Some classifications of domain names will be able to have additional requirements, to see III.c.
If a request of domain name does not fulfill the requirements described here, the request of domain name will not be accepted and there will be no another responsibility of NIC Mexico towards this request except for the one to provide information related to the refusal of the registry, having the applicant to make another request with the necessary requirements so that NIC Mexico can take care of it.
All the requests of registry will have to be sent through the page of NIC Mexico (http://www.nic.mx ) or alternating mechanisms that NIC Mexico establishes for benefit of the clients.
NIC Mexico reserves the right of not processing the requests received by some means different from described here.
Procedure
The requests of registry received by NIC Mexico will be processed (they will transact) in the order in which they are received according to the classification (Annexed A), applying the policies described in document RFC 1591 in the related thing to the order of attention to the requests.
Requests for domain names will not be admitted to transaction that already are in the Registry of Names of domain MX previously enrolled.
For each request of received registry, NIC Mexico it will send of return by electronic mail a comprobante of reception of the request, as it does not indicate that this one will be accepted. NIC Mexico does not become person in charge if the indicated account of mail is not working.
Previous fulfillment of the corresponding requirements, and within the 24 following capable hours to the request of the domain name, NIC Mexico will notify by electronic mail, to the administrative contact and/or applicant on the registry of the domain name.
Classifications
The names of domain under ccTLD MX will be able to be registered if they are fulfilled the requirements indicated in the Annex To, Table of Classifications of MX.
There is registry of no names of domain directly under MX, therefore the requests for these names of domain will not be accepted. This classification was used until March of 1997 for the names of domain of educative institutions and similar, now the EDU.MX is used . The domain names that already are registered under MX not will see affected.
These classifications can increase, previous warning of NIC Mexico through their page WEB.
Obligations of the Contacts of the Name of domain
Contacts for each name of domain will have to maintain his data constantly updated, since it is of extreme importance which they are to as much of any information relative to the domain names, including notifications of payment. Also they are committed to accept the established thing in II.b.ii and III.
The holders of the domain name are responsible by the use for the same one and the subdomains that they delegate as well, as well as for the services that their clients and/or users lend to.
The contacts administrative and technical are only the authorized one to make changes to the data of the domain name and will be considered Titulares of the domain name. The payment contact is the person in charge to take care of the notifications of payment, warnings of elimination by lack of payment and will be the unique one that will be able to ask for the change of SUSPENDED status of FINAL, the intention of payment and/or payment the same one.

IV. Of the Payments of quotas for the Names of domain
Quotas
NIC Mexico will apply the quotas described in the ANNEXED B, TABLE OF QUOTAS. In this table they include the following columns:

QUOTAS,
AMOUNT TO PAY,
PERIOD OF COVER,
NAMES OF domain REQUIRED TO SETTLE QUOTA,
PERIOD OF GRACE FOR THE PAYMENT.
Different types from quotas exist, as it is in the column "QUOTAS".
The amount to cover this dice by the column "AMOUNT TO PAY".
The domain name will be covered during the time described in the column "PERIOD WITH COVER", according to these Policies.
The domain name will have to cover the quota that corresponds according to indicated in the column "the NAMES OF domain REQUIRED TO SETTLE QUOTA".
The payment of the quota will have to be made within the specified time in the column "PERIOD OF GRACE FOR the PAYMENT".
In order to process his payments it is necessary that it makes the described intention of payment in IV.c.i
Of not receiving the intention of payment within the time specified in the column "PERIOD OF GRACE FOR the PAYMENT", NIC Mexico will be able to suspend of the data base the domain name according to the described thing in VI.a .
NIC Mexico will announce in its page WEB any change in the quotas of domain names. The application of these changes does not have retroactive character.
Warnings of Collection
NIC Mexico will be able to send a first warning of collection 30 days before the date payment limit, via electronic mail, to the contact of payment for each name of domain.
NIC Mexico will be able to send a second warning of collection 15 days before the date payment limit, via electronic mail, to the contact of payment for each name of domain, unless it receives and it processes the intention of payment.
NIC Mexico will be able to send a last warning of collection the day previous to the date payment limit, via electronic mail, to the contacts technical, administrative and of payment of each name of domain, unless it receives and it processes the intention of payment.
NIC Mexico is not forced to notify to the contacts by any other means different from the electronic mail.
Payments and Intentions of Payment
So that the intention of payment is made, it registers and it comes will have to be made in the page of NIC Mexico (http://www.nic.mx ). When the domain name has the SUSPENDED status of FINAL, an additional position according to the described thing in Annexed the D will become and the domain name will be reactivated once the corresponding payment has been made.
The intentions of payment have a use according to is indicated in the Annexed C, Table of Methods of Payment. It is responsibility of the payment contact to make the payment immediately after generated the intention of payment, with the purpose of avoiding the victory of the same one. The received payments related to overcome intentions of payment will not be credited.
The payment will have to take place in the equivalent one in Mexican pesos according to the type of change at the time of making the intention of payment according to is indicated in the Annexed C, Table of Methods of Payment:
NIC Mexico will not process those intentions of payment that do not follow the procedure indicated of the Annexed C, Table of Methods of Payment, or they do not respect the date of victory of the intentions of payment.
Of the same form, those intentions of payment will not be processed that are insufficient to cover the certain quotas. These payments will not modify the PERIOD OF GRACE FOR the PAYMENT.
The made payments are not reimbursable nor transferable.
In case of checks given back by the bank or positions to credit cards that do not come, the respective intentions of payment will be cancelled, being responsibility of the payment contact to send new intentions of payment, and to cover the surcharges by commissions generated by these situations.
In case of positions to credit cards that the client protests or does not know, the respective intentions of payment will be cancelled, being responsibility of the payment contact to send new intentions of payment.
Invoices
In case that the payment contact asks for invoices by the made payments, these will be:
Shipments exclusively to the direction that the applicant indicates in the intention of payment, after the payment has taken place and registered. To see ANNEXED C, Table of Methods of Payment. Post-office boxes in the shipment direction will not be accepted.
Make available in the facilities of NIC Mexico to the person indicated in the intention of payment. This invoice will only give previous identification with official document (Credential IFE or Passport).
It is exclusive responsibility of the payment contact to provide in time and forms correspondiente.Los the data necessary to emit the invoice data will have to exclusively provide only and when making the intention of payment, and it will be exclusive responsibility of the payment contact to send the correct information and completes.
In case of not receiving the information in the time and it forms indicated, the payment contact separates of any type of responsibility to NIC Mexico, in relation to the emission of the invoice and the breach of the obligations of the payment contact.
Modes of payment
The modes of payment accepted by NIC Mexico are described in the Annexed C, Table of Methods of Payment.
NIC Mexico will not accept any other mode of payment that is not defined in the Annexed C, Table of Methods of Payment.
NIC Mexico reserves the right to suspend temporarily or to eliminate some mode of payment described in the ANNEXED C, indicating it this condition in the page of Internet of NIC Mexico (www.nic.mx), reason why the intentions of payment will be only processed previous to the publication of this circumstance.

V. Of the Modifications of Names of domain
The modifications are any change or update to the data of a Name of domain.
The holders (contacts technical and administrative) of the name of domain are only the authorized one to make the modifications in the domain name.
The modifications that can be made to the domain name are:

Change of Contacts:
Administrative,
Technician, and Of Payment
To add, to eliminate or to modify Servants of Nombres (DNS)
Under no circumstance the name of a Name of domain will be able to be modified.
If the modification includes a new Servant of Nombres (DNS) for the domain name, this DNS will have to respond autoritativamente for the name of domain at the time of the modification request, otherwise this request will not be accepted.
In order to make any modification to the information related to the domain name, the holders will have to follow the following procedure:
In order to make a modification he requires himself to fill the request that is in the page of modifications of NIC Mexico.
NIC Mexico will send an electronic mail to the holders (contacts technical and administrative) in order that they authorize the asked for modifications. NIC Mexico does not become person in charge in case that the accounts of mail of the holders of the domain name do not work.
If 10 days after to have received the request of modification of a domain name, some of the holders did not respond, the modification will be made according to the instructions of the contact that if it has responded, since it is obligation of both is to respond to official notices of NIC Mexico on his names of domain.
If 10 days after to have made the request of modification of a domain name, no of the holders responded, the modification request will be cancelled.
The confirmation of the made modifications, or in their defect, the rejection of the request and its causes, will be sent to the applicant via electronic mail.
NIC Mexico will not process the requests received by some means different from the page WEB.

I SAW. Of the Suspensions and Eliminations of Names of domain
By suspension the incapacitation is understood of the domain name to be solved by the DNS of Internet and the incapacity of which third it can ask for it and/or register. A domain name will be able to have estatus of initial suspension, final suspension and suspension by external authority. A domain name could be suspended:
Not to make the payment of some quota within the defined PERIOD OF GRACE. The time of suspension of the domain name will be of 15 days from the victory of the PERIOD OF GRACE, being this one the initial suspension, and only the payment contact will be able to reactivate it within these 15 days if cuota(s) makes the payment of la(s) pendiente(s).
Not to make the payment of some QUOTA, to more taking 15 days after to have suspended initially, being this one the final suspension. The additional time of suspension could be until of 15 days, and solely the payment contact, will be able to reactivate it within this period, being made the payment of la(s) cuota(s) pendiente(s).
In case of being fulfilled some of the conditions it will be suspended by external authority following:
To provide incorrect, false or inexact information in the request of the domain name, or in the information maintained in the data base WHOIS;
Not to update the information described in the II.b.ii and III.d.i.
Use of a name of domain with aims different from had in the column "Intention" or the breach of some of the requirements indicated in the Annex To, Table of Classifications.
If some of the previous assumptions were fulfilled, the suspension of the domain name will be able to take place according to the procedure that is described next:
NIC Mexico will be able to initiate the procedure of falsification of data when motupropio or by warning of some third it found out that a domain name is in some of the conditions described in VI.a.iii
When these assumptions informed of NIC Mexico on the part of some third, this one will have to warn NIC Mexico by electronic mail of the lack that has detected in relation to a domain name, and will tell on 5 days natural following the date of the warning to make arrive at NIC Mexico, by mail, the physical tests and/or documents available that therefore they demonstrate it.
NIC Mexico when receiving or counting on the pertinent tests, within the 15 following days to the date of reception or obtaining of the tests will be able to investigate and to confirm the veracity of these.
If the lack is confirmed, NIC Mexico, within the 5 following days to the date in which the lack was determined, it will contact the holders of the domain name and these will have a term greater to 10 days not to send comprobantes that justify it.
From not receiving documentation that justifies this lack within the established term or not receiving communication on the part of the holders within first 5 days NIC Mexico it will be able to come with the suspension.
The time of suspension will be of up to 15 days in which the holders, will not be able to reactivate it or to ask for it.
By resolution emitted by some authority.
By elimination the incapacitation is understood of the domain name to be solved by the DNS of Internet, but being this one available one to ask for itself by third. A domain name could be eliminated:
To request of the holders of the domain name
This request will have to make it the holders by means of the page WEB of NIC Mexico. So that the holders can send this request, the domain name must not have pending debits.
NIC Mexico will send electronic mail to the holders in order that these authorize the asked for eliminations.
If 10 days after to have made the request of elimination of a domain name, not yet responded both holders, the elimination request will be cancelled.
The confirmation of which the eliminations have been made, or in their defect, the rejection of the request and its causes, will be sent to the applicant via electronic mail.
NIC Mexico will not process the requests received by some means different from the page WEB.
By resolution emitted by some authority.
When finalizing the period of final suspension.
For the domain name in which a DNS servant has provided itself at least, not to maintain a service of resolution (DNS responding autoritativamente) for the same one. In this case, a warning by means of electronic mail will be sent to the technical contact, in where a term of 10 days will be granted to fulfill this requirement, otherwise it will be possible to be come with the elimination of the domain name.
Not to respond to official notices of the NIC Mexico. When it is necessary to contact with the holders and some of them did not respond, the domain name will be able to be eliminated in 10 days later the official notice or not to receive documentation according to the established thing in the VI.a.iv point.
When applicant and/or titular(es) of or the names of domain it fails to fulfill anyone of the points established in the present Policies.

VII. Of Disputas de Nombres de Dominio
By Titularidad
If there were dispute between the people in charge of the domain name and/or third on the titularidad of the domain name (with the exception of relative to Registered tradenames who comment in the VII.b point of these policies), that looks for the titularidad of the domain name will have to ask for the beginning of Disputa by Titularidad sending an electronic mail to the legal Area of NIC Mexico.
NIC Mexico will initiate the procedure when it asks for by electronic mail to both parts (Titular present and to who initiates the dispute) documents that prove their titularidad, which limit a:
Copy certified of Invoices of the supplier in where the name of domain at issue is specified.
Simple copy of the invoice of NIC México.Esta proves was not accepted in the assumptions of the IV.c.viii point.
Copy certified of contracts or agreements celebrated between the parts in where the name of the domain is specified.
In case of of not having asked for an invoice, it copies registered letter of the comprobante of the banking deposit (with anyone of the institutions shown in the annexed C) with bench mark of the domain name.
This documentation will have to be received via postal mail to NIC Mexico within next the 15 days.
NIC Mexico will solve the titularidad to name of that straight has the best one on the name of domain on the basis of received documents.
NIC Mexico reserves the right of not solving the dispute when it considers that the case exceeds its faculties; or the best one on the part of the applicant is not verified straight
Of Intellectual Property
By registered tradename of products or registered services, commercial warnings, denominations of origin, reserves of rights;
For the resolution of any controversy derived from some violation to rights of intellectual property the Policy of Solution of Controversies in the matter of Names of domain for MX (LDRP) and the Regulation will be applicable .
