Article 1
General Requirements
1. Applicants who apply for the registration of a domain name in the Macao SAR (hereinafter referred to as domain name) -- .mo must fulfill the following conditions:
1) They must be legal or self-employed persons who are registered within the Macao SAR;
2) The applicant must make every effort to ensure that the primary domain name server (primary DNS) will function continuously for its domain name;
3) The applicant must appoint an administrative representative to manage its domain name and a technical representative to operate its domain name server.
2. Domain name holders with the domain name suffix .com.mo, .edu.mo, .org.mo, .net.mo and .gov.mo have the right to apply for same domain names under the suffix .mo.
3. If the domain name registration procedures and other related matters are handled by a representative, a document from the applicant indicating the scope of the entrusted matters and duties must be submitted.
Article 2
Special Requirements
1. Applicants who apply for third-level domain names must fulfill the following conditions:
1) Applicants who apply for domain names with the suffix .com.mo must submit documentary proof that its commercial company or offshore organization is registered within the Macao SAR, or documentary proof that the firm is open for business, or documentary proof of his or her self-employed qualifications.
2) Applicants who apply for domain names with the suffix.net.mo must submit copies of the respective License for the Provision of Internet Services or License for the Provision of Telecommunication Services as issued by the Macao Government or authorization documents to utilize Macao SAR Internet Resources issued by the Macao Government;
3) Applicants who apply for domain names with the suffix .org.mo must submit relevant documentary proof that the organization has been registered within the Macao SAR, or is a public entity within the Macao SAR;
4) Applicants who apply for domain names under the suffix .edu.mo must submit documentary proof that the educational institution is accredited by the Education and Youth Affairs Bureau or present equivalent documents;
5) Applicants who apply for domain names with the suffix .gov.mo must be a public entity within the Macao SAR.
2. Applicants who apply for domain names with the suffix .mo must submit the documents as required for the registration of a third-level domain.
3. Applicants who apply for a domain name in regards to a trademark / patent must submit a copy of the registration certificate of the trademark / patent issued by the Macao Government.
4. If the applicant is not the trademark or patent holder, then a notarized written consent signed by the actual holder must be submitted.
Article 3
Registration
1. Save for good reason, the domain name registration application will be analyzed on a first-come first-served basis.
2. The requested domain name must match either the name of the entity registered within the Macao SAR, the trademark registered within the Macao SAR or the patent registered within the Macao SAR.
3. Without prejudice to the provisions of the preceding paragraph, the applicant may, as a basis for the request, apply for a domain name associated with or representative of the name of the entity.
4. Regarding the situations referred to in the preceding paragraph, the requested domain name will be published within the of Macao Network Information Center website for a period of thirty days.
5. If there is no objection within thirty days of the publication, the relevant application referred to in Article 3 will be approved.
6. If there is an objection within the publication period, the applicant’s explanation must first be heard before the final decision is made.
7. Non-profit organizations which satisfy the requirements of Article 2 Item 1.3 or 1.4 may apply for non-profit services or activities-related domain names with the suffixes .org.mo or .edu.mo.
8. For the situations referred to in the preceding paragraph, applicants must submit a brief description of the related non-profit services or activities.
Article 4
Duration
The duration of a domain name registration is one year, and may be renewed for an equal period.
Article 5
Application Procedures
1. Applicants may apply at the Macao Network Information Center in person or fill out the digital domain name registration application form on its website.
2. Applicants must, on the date or within eight days from the date of submission of digital application form:
1) Submit a notarized signed Letter of Confirmation;
2) Submit the documentary proof and relevant photocopies mentioned in Articles 1 to 3 and;
3) Pay the fee for registration of the domain name.
3. If deemed necessary, the applicant may be required to submit necessary supplementary information or documents for the purposes of analyzing the eligibility of the domain name registration application.
4. If any of the documents or registration fees described in Article 2 are not submitted within the stated period, the domain name registration may be cancelled without any notice.
5. If the domain name registration application is not accepted, all associated charges will be refunded.
Article 6
Responsibilities
1. Applicants shall be fully responsible for their chosen domain names.
2. Applicants must ensure that domains applied for registration do not harm the interests of the third party and are not used for illegal purposes.
3. Any person who or which breaches the provisions of the preceding paragraph or if the relevant operations of its domain name is deemed a threat to the security and stability of the Internet, such domain name will be suspended immediately.
4. In the occurrence of the situation referenced in the previous paragraph, the domain name holder must, within sixty days, provide an explanation, submit supporting evidence and/or make the necessary corrections.
5. If the provisions of the preceding paragraph are not observed, the domain name will be cancelled, without prejudice to other obligations incurred.
Article 7
Rejection
The domain name applications or renewals of applications from applicants who or which do not meet the requirements of this Regulation shall be rejected.
Article 8
Renewal
1. Before the expiry of the domain name registration, the domain name holder may apply for the renewal of the registration, and submit all the latest documents, relevant photocopies and pay the necessary charges.
2. If an entity as specified in Article 3, paragraph 7 wishes to renew a registration, the domain name holder must prove the validity or continuity of its non-profit services or activities.
3. If no application for the renewal of the domain name registration is made, or if the domain name holder fails to complete the renewal application for reasons attributable thereto before the expiry of the domain name registration, the domain name will be suspended for a maximum period of sixty days.
4. If, after the end of the suspension period specified in the preceding paragraph, the domain name holder has not requested for a renewal of the domain name registration or completed the renewal application procedures, the domain name will be cancelled with immediate effect.
Article 9
Review
1. The qualifications of the domain name holder may be reviewed at any time.
2. If the domain name holder does not meet the qualifications required for a domain name application, its domain name will be cancelled.
Article 10
Cancellation by the Domain Name Holder
If a domain name holder wishes to cancel a domain name, a notarized Letter of Cancellation must be submitted thereby.
Article 11
Fees
Fees for the registration and renewal of domain names renewal are set by the Bureau of Telecommunications Regulation and published within the website of Macao Network Information Center.
Article 12
Domain Name Composition
1. Domain names must have a length of not more than 63 characters and must consist of the letters A to Z of the English alphabet (uppercase or lowercase), the numbers 0-9 or hyphens (-).
2. English alphabet or numbers must be used at the beginning and at the end of a domain name, and the third and fourth characters of a domain name cannot be hyphens simultaneously.
Article 13
Reserved Domains
1. Reserved domain names include the following categories:
1) All domain names consisting of one character;
2) All domain names consisting of two characters;
3) Generic Top-Level Domains (GTLD) and Industry Category Top-Level Domains as announced by the Internet Corporation for Assigned Names and Numbers (i.e. ICANN);
4) Country-Code Top-Level Domains (ccTLD) as announced by the Internet Assigned Numbers Authority (i.e. IANA);
5) Technical Terms and other reserved domain names as announced by the Macao Network Information Center.
2. Unless there is a justifiable reason, applications of domain names found within the list of reserved domain names will not be accepted.
Article 14
Dispute Resolution
1. The parties to a dispute shall be required to handle all disputes arising from the registration and operation of domain names, and must assume all liability incurred.
2. When a dispute arises or when a dispute is resolved, the respective party must notify the entity responsible for registration and management of domain names in writing.
3. The entity responsible for the registration and management of domain names shall not be involved in any dispute arising from the registration and operation of domain name, and will not act as mediator or arbitrator.
Article 15
Transitional Provisions
For domain name registrations that have expired before the publication of this regulation and which have not yet been cancelled, the domain name holder has to apply for the renewal of domain name registrations within 6 months from the publication of this regulation, otherwise such domain names will be cancelled immediately.
Article 16
Final Provisions
This regulation applies to domain name registration applications currently being processed.
