1. Definitions
1.1 Domain Name: means the domain name assigned by the Registry
to the Registrant.
1.2 Domain Name Registration Application Form of .ae: means
the form published by the Registry for the purposes of soliciting
information from persons or entities seeking to register an Internet
domain name, which can be found on the World Wide Web
1.3 Terms and Conditions of .ae: means the Registry’s terms and
conditions governing the registration and use of a domain name
registered with the Registry and published on the World Wide Web
1.4 Privacy Policy of.ae: means Privacy & Whois Search Service
Policy of .ae is to be read and used in connection with the
Registration Policies of .ae and as a part of the registration
Agreement of .ae published on the World Wide Web
1.5 Registration Policies and Rules of .ae: means .ae Registry’s
Registration Policies or Domain Name Registration Policies and
Rules of .ae published on the World Wide Web
1.6 Dispute Rules of .ae: means Rules for Domain Name
Dispute Resolution Policy for .ae
1.7 Dispute Policy of .ae: means the Dispute Resolution Policy for
Domain Names registered with the Registry, and published on the
World Wide Web
1.8 UAEnic: United Arab Emirates Network Information Center
"UAEnic": is part of Emirates Telecommunications Corporation -
Etisalat. It was launched as the Registry of .ae to tackle the
Registration for the sub-level domain names and as the ccTLD
Manager of .ae.
1.9 Registration Agreement: means Domain Name Registration
Agreement of .ae, published on the World Wide Web which include the following:

2. Scope
2.1 These Terms and Conditions shall apply to any application to register
an Internet domain name with UAEnic and the subsequent
registration or use, direct or indirect, of the Domain Name.
2.2 By completing and submitting a Domain Name Registration
Application Form of .ae for consideration and acceptance by the
Registry, the Registrant acknowledges that he/she has read the
Registration Agreement including these Terms and Conditions of .ae.
2.3 In the event that a domain name is registered in the Registry’s
domain name database and assigned to the Registrant, the Registrant
agrees to be bound by the Registration Agreement including these
Terms and Conditions of .ae.
3. Registrant
3.1 Any individual over the age of twenty one (21) years and any legally
recognized entity, irrespective of whether or not the person or entity
is residing or located in United Arab Emirates, is eligible for the
registration of domain name(s) under .ae.
3.2 Any Israeli individual or entity shall not be eligible for the registration
of domain name(s) under .ae. UAEnic shall have the right to remove
any domain name, which the Israeli Boycott Office Rules and
Regulations in the UAE decide that it is similar or identical to an
Israeli’s, or any Intellectual Property Right belonging to person(s)
under an interdict by virtue of a decision to that effect.
3.3 The legal age of Natural person: Natural person over the age of
twenty one (21) years is eligible to apply for registration of subdomain
name under .ae and/or UAEnic services and become the
“Registrant” of the .ae as per the Registration Agreement of .ae.
3.4 Natural persons who are at the age of sixteen (16) and above but
under twenty one (21) years must submit a parental or guardian
guarantee together with the Domain Name Registration Application
Form of .ae.
4. Domain Name
Any Registration of Domain Name(s) under .ae shall comply with the
Registration Policies and Rules of.ae.
5.Authorized Representation
5.1 An authorized representative may represent the Registrant (Natural
person/legally recognized entity).
5.2 The authorized representative shall sign the Domain Name
Registration Application Form of .ae on behalf of the Registrant after
having submitted all relevant authorized representation documents.
5.3 The relevant authorized representation documents shall be
compatible with the nature of the status of the entity.
5.4 Should the Registrant not reside or not be located in the United
Arab Emirates, a local representative who shall be bound by
provisions above shall represent him/her.
5.5 Should the Registrant not reside or not be located in the United Arab
Emirates, the contact person for billing purpose shall be a local (any UAE
Natural person/legally recognized entity having an office in the UAE).
6. How to Register a Domain Name
Registrant shall visit Etisalat office physically and provide Etisalat with the
completed registration application form of .ae duly signed and should
provide any document, which may be relevant to the sub-domain applied.
These documents shall be duly authenticated, if necessary as per the rules
and laws of the United Arab Emirates.
7. Language
All communications between Registry and Registrant in relation to the
registration of a domain name shall be in Arabic or English as requested by
Registry.
8. Fees and Payments
8.1 As consideration for the registration of the Domain Name with the
Registry, the Registrant agrees to pay the Registration Fee and, when
applicable, the Renewal Fee.
8.2 Receipt of the Registration Fee by the Registry, or the Registry’s duly
appointed agent, shall constitute confirmation of the Registrant’s
acceptance of the Registration Agreement including these Terms and
Conditions.
8.3 The Registry shall have no obligation to activate a Domain Name
unless and until it has received payment of the Registration Fee or
Renewal Fee, as the case may be.
8.4 Except as specified herein, all payments made in connection with the
registration of the Domain Name, or the renewal of the Domain
Name registration, shall be non-refundable.
8.5 Subject to Article No. (30) under these terms and conditions, the
Registration Fee shall cover a period of one (1) or three (3) or ten
(10) year(s) for each new registration, and it is considered for each
renewal, including any permitted modification(s) to the Domain
Name’s record during the covered period. At the conclusion of such
registration period(s), as the case may be, failure by the Registrant or
his representative to pay the Renewal Fee within the time specified
in a second notice or reminder served by Etisalat/UAEnic shall result
in cancellation of the Domain Name subscription.
8.6 In the event that the Registrant uses an agent for the purposes of
making any required payments, the Registry shall first seek payment
from the agent. In the event that the agent fails to make such
payment, for whatever reason, the Registry shall have the right to
recover the payment from the Registrant.
8.7 The Registration Fee and the Renewal Fee, as the case may be, shall
be paid by such means and the Registry may specify methods as from
time to time.
9.Accuracy of Information
9.1 For the purposes of applying to register the Domain Name, the
Registrant shall be required to provide the information requested in
the Domain Name Application form of .ae. The Registry shall take
reasonable precautions to protect all such information from loss,
misuse, unauthorized access or disclosure, alteration or destruction.
9.2 By applying to register a Domain Name, the Registrant represents
and warrants that, to the best of the Registrant’s knowledge and
belief, any information provided in the Domain Name Registration
Application Form of .ae is true and correct.
9.3 The Registrant represents and warrants that any future changes to
the information provided in the Domain Name Registration
Application Form of .ae required to maintain its accuracy shall be
provided to the Registry in an expeditious manner in accordance
with the domain name modification procedures in place at that time.
9.4 The Registry shall have no obligation to screen information
submitted by the Registrant to determine the accuracy of the
information held by the Registry nor to determine whether the
information may infringe the right(s) of a third party, but may rely on
the representations and warranties provided by the Registrant. The
Registrant agrees that, by the registration of the Domain Name,
such registration does not confer immunity from objection to
either the registration or use of the Domain Name by any party.
9.5 The Registry reserves the right to cancel the Domain Name if
Domain Name Registration Application Form of .ae, or subsequent
modification(s) thereto, contains false or misleading information, or
conceals or omits any information the Registry would likely have
considered material to its decision to accept the Domain Name
Registration Application Form of .ae and assign the Domain Name to
the Registrant.
9.6 A Registrant’s provision of inaccurate or unreliable information, its
failure promptly to update information provided to the Registry, or
its failure to respond for over fifteen (15) calendar days to inquiries
by the Registry concerning the accuracy of contact details
associated with the Domain Name shall constitute a material
breach of the Registration Agreement of .ae and shall be a basis for
cancellation of the registration of the Domain Name.
9.7 In the event the Registrant licenses the use of the Domain Name
to a third party, the Registrant shall nonetheless continue to be
considered the holder of record of the Domain Name and shall be
responsible for (i) providing its own full contact information, (ii)
providing full contact information for its licensee, and (iii) and for
providing and updating accurate technical, administrative, and other
contact information adequate to facilitate timely resolution of any
problems that may arise in connection with the Domain Name.
9.8 The Registry shall, upon notification by any person of an inaccuracy
in the information provided in the Domain Name Registration
Application Form of .ae, take reasonable steps to investigate that
claimed inaccuracy. In the event the Registry ascertains that
inaccurate information has been provided, it shall take reasonable
steps to correct any such inaccuracy.
10.Acceptance
The Registration Agreement of .ae shall be deemed accepted at the
offices of the Etisalat/Registry following the receipt of all payments by
the Etisalat/Registry in accordance with Article No. (8) and further to
the notification by Registry of the successful registration by any type of
communication means such as e-mail or otherwise.
11. Confidentiality
11.1 By submitting the Domain Name Registration Application Form of
.ae and in the event that the Domain Name is registered, the
Registrant, the Registrant’s agent (where applicable) and the Billing
Contact hereby give their consent to the inclusion of their names,
contact details and other details relating to the registration of the
Domain Name in the Registry.
11.2 The Registry shall be permitted by the Registrant and the Billing
Contact and or the Registrant’s agent to allow other organizations
and members of the public to access, through Whois Search
Service, any information provided by the Registrant in connection
with the Domain Name for the purpose of obtaining information about
the registration of the Domain Name or any other related purpose.
11.3 The Registrant or the Registrant’s agent, as the case may be, shall
expressly obtain the consent of third party individuals whose
personal data is to be held in the Registry and if such consent is
withheld or withdrawn then the agent shall immediately terminate
the registration.
12. Registration Policies and Rules of .ae
The Registry will process the application and consider whether to
accept or reject it in accordance with the terms of the
Registration Agreement of .ae which can be found at:
including the criteria laid down in the Registration Policies and Rules of .ae which can be found at:
in force at the time of the application for registration, transfer or renewal.
13. First Come, First Served
The Registry shall Register Domain Names on a first come, first served
basis. The Registrant agrees not to take any steps in reliance upon the
prospective registration of a Domain Name before it becomes a
registration entered in the Registry database.
14. Right of Refusal
14.1 The Registry, in its sole and absolute discretion, reserves the right
to refuse to register a domain name.
14.2 The Registrant agrees that the submission of an application to
register a domain name does not in any way obligate the Registry.
14.3 The Registrant agrees that the Registry shall not be liable for loss
or damages that may result from the Registry’s refusal to accept an
application by the Registrant to register a domain name.
14.4 In the event an application is not accepted, the Etisalat/Registry may
notify promptly the Registrant or the Registrant’s agent and return
any fees received.
15. Domain Name Dispute Policy
15.1 The Registrant agrees to be bound by the Dispute Policy of .ae, which
is incorporated herein by reference and made a part hereof. The
version of the Dispute Policy of .ae currently in effect can be found
15.2 Any dispute arising out of or in connection with the registration or
use of the Domain Name where at least one of the parties is not
located in UAE shall be subject to the dispute Policy of .ae.
15.3 Any dispute arising out of or in connection with the registration or
use of the Domain Name where both parties to the dispute are
located in UAE shall be referred to and finally determined by the
courts of UAE, unless both parties expressly agree in writing to
resolve such dispute in accordance with the Dispute Policy of .ae.
16. Entirety of Understanding
The Registrant agrees that these Terms & Conditions and Registration
Agreement of .ae are the complete and exclusive agreement between the
Registrant and the Registry regarding the registration of the Domain
Name under .ae. These Terms & Conditions and Registration Agreement
of .ae supersedes all prior agreements and understandings, whether
established by custom, practice, policy, or precedent. Except where
provided otherwise in the Registration Agreement of .ae, no variation may
be made to the Registration Agreement of .ae unless such is in writing and
approved by the Registry of .ae.
17.Agents
17.1 Registrant agrees that if an agent for the Registrant, such as an
Administrative Contact/Agent, completes these Terms & Conditions
the Registrant is nonetheless bound as a principal by all
terms/articles of the Registration Agreement of .ae.
17.2 The acceptance of the Registration Agreement of .ae by any agent for
the Registrant (whether by e-mail or other means) shall bind such
agent as if he/she were a principal to the Registration Agreement of .ae.
18. Breach
The Registrant agrees that failure to abide by any provision of these Terms
& Conditions and Registration Agreement of .ae may be considered by the
Registry to be a material breach and that the Registry may provide a
written notice, describing the breach, to the Registrant. If, within thirty (30)
days of the date of mailing such notice, the Registrant fails to provide
evidence, which is reasonably satisfactory to the Registry that it has not
breached its obligations, then the Registry may delete Registrant’s
registration of the Domain Name without any refund entitlements and/or
fees for the Registrant and without prejudice to any other remedies to
which the Registry may be entitled. Any such breach by a Registrant shall
not be deemed to be excused simply because the Registry did not act
earlier in response to that, or any other, breach by the Registrant.
19. Cancellations,Transfers, and Changes
19.1 As per applicable fee, the Registry reserves the right to cancel,
transfer or otherwise make changes to domain name registrations
under the following circumstances:
(i) the Registry’s receipt of written or appropriate electronic instructions
from the Registrant or the Registrant’s agent to take such action
(ii) the Registry’s receipt of an order from a court or arbitral tribunal,
in each case of competent jurisdiction, requiring such action
(iii) The Registry’s receipt of a decision of an Administrative Panel
requiring such action in any administrative proceeding to which the
Registrant was a Party pursuant to the Dispute Policy adopted by the
Registry
19.2 The Registry also reserves the right to cancel, transfer or otherwise
make changes to the Domain Name registration in accordance with
other legal requirements.
20. Registry Liability
20.1 The Registrant agrees that the Registry shall have no liability to the
Registrant for any loss or damages:
(i) in connection with the Registry’s processing of the Domain Name
Registration Agreement of .ae and Domain Name Registration
Application Form of .ae; or
(ii) in connection with the Registry’s processing of the Domain Name
Transfer Agreement of .ae; or
(ii) in connection with the Registry’s processing of any authorized
modification to the Domain Name record during the period of any
registration; or
(iii) resulting from the refusal of the Registry to accept any
application for registration (save to refund any fee paid by the
Registrant to the Registry); or
(iv) as the result of any failure on the part of the Registrant’s agent
to pay either the Registration Fee or the Renewal Fee; or
(v) as a result of the application of the Dispute Policy
20.2 The Registrant agrees that in no circumstances shall the Registry be
liable for any loss of profit, loss of business or anticipated savings
suffered by the Registrant howsoever incurred.
20.3 The Registrant agrees that the Registry shall not be liable for any loss
of registration or loss of use of the Domain Name, or for
interruption of business, or any indirect, special, incidental or
consequential losses of any kind (including lost profits) whether in
contract, tort (including negligence) or otherwise.
21. Indemnity
21.1 The Registrant shall hold the Registry and any of its directors,
officers, employees and agents harmless from any claim by a third
party arising out of or in connection with (i) the registration or use
of a domain name, or (ii) the implementation by the Registry of any
order or decision issued under the Dispute Policy of .ae. Such claims
shall include, without limitation, those based upon intellectual
property trademark or service mark infringement, trade name
infringement, dilution, tort interference with contract or prospective
business advantage, unfair competition, defamation or injury to
business reputation. Such obligation shall continue in effect after the
termination of the Domain Name Registration Agreement of .ae.
22. Legality of Registration and/or Use of Domain Name
22.1 The Registrant represents and warrants that he/she has exercised its
best efforts to determine that neither the registration of the Domain
Name nor the manner in which it will be directly or indirectly used
shall not infringe or otherwise violate the legal rights of
Etisalat/UAEnic and/or any third party.
22.2 The Registrant represents and warrants that, to the best of the
Registrant’s knowledge, the registration or use, direct or indirect, of
the Domain Name does not and will not violate any applicable laws
or regulations.
22.3 The Registry does not accept any responsibility for the registration
or use of the Domain Name or information generally held in the Registry,
for any unlawful act(s) including but not limited to the following:
(i) Violation of Intellectual Property Rights: copyright, trademark,
patents, trade secret, and other Intellectual Property Rights
(ii) Hacking such as the promotion or participation in the destruction
or compromising the integrity of UAEnic/Etisalat
(iii) Defamation such as the distribution of defamatory speech over
the Internet, which can lead to the such criminal or civil liability
(iv) Interference with the State’s policy such as jeopardizing the
state’s national interest or bothering any other countries
(v) The publication of news, pictures or comments related to private
family secrets of individuals even if the published material is true
(vi) Adult sites such as pornographic material links to adult’s sites, or
advertisements for adult sites
(vii)Any other unlawful purposes including but not limited to gambling,
obscenity or any activity that contradicts with the social, cultural,
political, economical or religious values of the United Arab Emirates.
23. Clause Headings
Clause headings are for ease of reference and are not part of these Terms
& Conditions and Registration Agreement of .ae and accordingly shall not
affect its interpretation.
24.Termination
24.1 The Registrant may terminate these Terms & Conditions/Registration
Agreement before its expiry by requesting the Registry to delete the
Domain Name from the Registry in accordance with the procedures
established by the Registry for such purposes.
24.2 The Registry may terminate these Terms & Conditions/Registration
Agreement before its expiry in the event that the Registry
determines, in its sole discretion, that there was a material
misrepresentation, material inaccuracy or materially misleading
statement in the information provided in the Domain Name
Application Form of .ae or in any subsequent modification thereof.
24.3 Termination of these Terms & Conditions/Registration Agreement
shall not determine rights and obligations between the parties that
are of a continuing nature nor shall modification, surrender,
cancellation or transfer of the Domain Name extinguish any rights,
which have accrued under the terms of the Registration Agreement.
25.Assignment
The Registry may assign the Registration Agreement of .ae in full or part.
The Registrant may assign the Registration Agreement subject to any
change made pursuant to Article 26.1 below, and transfer the registration
of the Domain Name, by strict adherence to the procedure in force at the
time of transfer and payment of the appropriate transfer fee applicable at
the time of the transfer. No other method of assignment is permitted for
these Terms & Conditions/Registration Agreement of .ae.
26.Amendments
26.1 The Registry reserves the right to modify these Terms &
Conditions/Registration Agreement at any time but at least fifteen days
(15) before they become effective. The revised version will be
posted at the UAEnic website as mentioned herein
In the event that Registrant object to a change in these Terms and
Conditions/Registration Agreement of .ae, Registrant’s sole remedy is
to cancel its domain name registration with the Registry database,
provided that Registrant will not be entitled to a refund of any fees
that Registrant paid to the Registry.The revised version will apply to
Registrant until Registrant cancels its Domain Name Registration.
26.2 Subject to UAEnic/Etisalat approval, transfer of domain name
registration under .ae is allowable to a third party, based on the
Registrant’s sole remedy, cost and liability.
26.3 Registrant may transfer the domain name to a third party subject to
the following:
a. the conclusion of a transfer agreement with the transferee as
prepared by Registry
b. the transfer shall be approved by Registry
c. the transferee shall be bound by the Registration Agreement of .ae
27. Governing Law
These Terms and Conditions and Registration Agreement of .ae shall be
governed in all respects by and construed in accordance with the laws of
the United Arab Emirates.
28. Disputes between Registry and Registrant / Third party
Any Dispute between Registry and Registrant/Third party, controversy or
claim arising under, out of or relating to these Terms and
Conditions/Registration Agreement of .ae and any subsequent
amendments of these Terms and Conditions/Registration Agreement of
.ae, including, without limitation, its formation, validity, binding effect,
interpretation, performance, breach or termination, as well as noncontractual
claims, shall be referred to and finally determined by national
courts of the United Arab Emirates.
29. Notice
29.1 Except as otherwise provided in this clause any notice to be given
under the Registration Agreement shall only be deemed served if
delivered by hand or sent by post, by fax or e-mail, to the party to
whom it is meant at its last known postal or e-mail address or fax
number.The notice will be effective: if delivered by hand, on delivery;
if sent by fax or e-mail, on transmittal; and if sent by post, on the
fourth day after posting.
29.2 Any notices to the Registrant concerning a dispute under the
provisions of the Dispute Policy shall be deemed validly delivered if
sent by e-mail to the address of the Administrative Contact as
specified in the Domain Name Registration Application Form of .ae.
30. Duration and Renewal of domain name Registration under .ae
30.1 Registration of domain name under .ae may be for a period/s as per
below conditions:
30.1.1 The minimum registration term is 1(one) calendar year - 12
(twelve) months.
30.1.2 The applicant may choose that registration be for a period/s of
one (1), three (3) or ten (10) year(s) for each new registration,
according to the application form of .ae submitted to
UAEnic/Etisalat or registrar of .ae.
30.1.3 The registrant shall be committed to settle all fees for the
duration/s selected, which are regulated in the registration
agreement of .ae and application form of .ae.
30.1.4 Agreed term/s may not exceed ten (10) years in maximum for
every time.This condition also applies to the renewals.
30.1.5 If the domain name holder finalizes the registration and pays the
renewal fee, the renewal of the registration effect shall commence
from the expiry date of the last term/s.
30.1.6 After the expiry of registration period/s it is necessary to observe
the following:
30.1.6.1 UAEnic/Etisalat and/or registrar of .ae shall notify the
applicant/registrant of domain name before the expiry of
registration term/s as follows:
30.1.6.1.1 After ten (10) months from the registration date the registrant
will receive an invoice by mail (post), which, shall include the
registrant account number, domain name, fee that should be
paid by the registrant to the Registry. After one month of this
invoice, a reminder by e-mail may be sent also to remind the
registrant for the domain name fee payment.
30.1.6.1.2 After twelve (12) months from the registration date, if the
registrant doesn’t pay his/her domain names fee, his/her domain
name shall be TOSsed ( Temporary Out of Service) for one month.
If domain name fee was paid during this period, the registrant
shall pay an additional fee of AED Twenty Five (25 U.A.E
Dirhams).
30.1.6.1.3 If the domain name fee is not paid within the (12) months of the
registration period of time, the domain name will be canceled
from the Registry databases and other related services as well.
Then the domain name may be offered to be registered in the
name of a third party (New Registrant) without any responsibility
or liability for Etisalat /UAEnic and/or registrar of .ae.
